When a judge grants probation in a DUI case, you avoid serving the full sentence up front. In exchange, you accept strict conditions the court can enforce for years.
For most misdemeanors, Penal Code 1203a caps probation at 1 year. That cap does not apply to offenses that set their own probation length, and DUI is one of them. Vehicle Code 23600 requires at least 3 years and no more than 5 years of DUI probation, regardless of the 1-year limit.
When the maximum prison term exceeds 5 years, probation can run longer, up to that maximum.
Penal Code 1203 distinguishes probation supervised by a probation officer from a conditional sentence, in which the court sets conditions without probation officer supervision. Many people call the second version informal or summary probation.
Inside city limits, the Los Angeles City Attorney's Criminal Branch prosecutes misdemeanors, including DUI cases. Knowing who prosecutes your case and who supervises you shapes how we respond to any violation claim.
Every California DUI probation order includes core terms under Vehicle Code 23600. While on probation, you must:
The court also cannot excuse the minimum jail time or minimum fine the law sets for your offense. For a first offense, Vehicle Code 23538 requires a $390 to $1,000 fine and allows the judge to add 48 hours to 6 months in county jail.
You must also enroll in and complete a state-licensed DUI program. Program length depends on your record and your test result:
The California Department of Health Care Services licenses these programs and states that internet classes do not satisfy the requirement. After a first offense, the Department of Motor Vehicles (DMV) will not restore your driving privilege until it receives proof that you finished. Our guide to how California DUI programs work covers enrollment and attendance.
Probation makes ordinary driving riskier. Vehicle Code 23154 makes it unlawful for anyone on DUI probation to drive with a BAC of 0.01% or higher.
By driving while on probation, you are deemed to consent to a preliminary alcohol screening test if an officer lawfully detains you. The officer must have reasonable cause to believe you are violating the 0.01% rule. Refusing or failing to complete that test leads to a suspension or revocation of your driving privilege for 1 to 3 years.
When a violation for driving with alcohol or refusing a test comes with a chemical test result over 0.04%, Vehicle Code 23600 requires the court to revoke or terminate your probation. Any new term can run up to 5 years and must include at least 48 hours in county jail for each violation, except in unusual cases.
Under Penal Code 1203.2, an officer with probable cause can rearrest you without a warrant, and the court can also issue one. The judge may revoke probation if the interests of justice require it and there is reason to believe you broke a condition or committed a new offense. Revocation also pauses the probation clock.
If the court revokes probation, the judge can impose up to the longest sentence allowed for the original offense, minus credits. Missing your DUI program carries its own risk. Vehicle Code 23538 requires the court to revoke probation when a first offender fails to enroll, participate, or finish, unless there is good cause.
Hurwitz Law Group also defends non-DUI probation cases, so if your violation involves something else, our Los Angeles probation violation attorney team can step in.
A violation allegation is not a finding. We test every claim before the judge acts on it, and depending on the facts, our defense may:
Penal Code 1203.2 bars revocation for nonpayment alone unless the court finds you willfully failed to pay while able to pay.
Penal Code 1203.3 gives the court authority to revoke, modify, or change probation at any time during the term. A judge can also end probation early when your good conduct and reform justify it, and the ends of justice are served. The request requires an open-court hearing and 2 days' written notice to the prosecutor.
Because DUI probation carries a statutory minimum term, early termination requests in DUI cases call for careful preparation. We gather proof of completed classes, paid fines, and a clean record to support your request.
Once probation ends, Penal Code 1203.4 allows the court to dismiss your case if you completed probation or were discharged early. A dismissal does not stop a later court from using the DUI as a prior conviction. Our DUI expungement services take over when you qualify.
A new arrest can trigger both a new criminal case and a violation allegation, because DUI probation bars any new offense. If a chemical test shows you drove with a BAC over 0.04%, the court must revoke or terminate probation. We defend the new charge and the violation together.
The required conditions focus on driving: You cannot drive with any measurable alcohol in your blood. Vehicle Code 23600 does not list drinking itself among the required terms, but your judge can add others, so read your sentencing order closely.
It depends on the type of probation the court granted. Formal probation involves a probation officer, while a conditional sentence runs on court-set conditions without one. We can confirm which applies to you.
Yes. Refusing a screening test while on probation can lead to a 1- to 3-year suspension or revocation. After a first offense, the DMV also will not restore your privilege until you complete your DUI program.
Yes, especially if the court issued a warrant or set a hearing. The judge can impose up to the maximum sentence, so early representation matters for your evidence and mitigation.
No. Penal Code 1203.4 relief is available only after probation ends or after the court discharges you early. We can ask for early termination first when your record supports it.

DUI probation leaves little room for error, and one allegation can undo years of progress. You do not have to face a violation claim or a confusing condition alone.
